These Terms & Conditions govern your use of SmartDrive Kenya, including its learning materials, Examination Centre, Mwalimu SmartDrive Kenya AI Tutor and other services. By creating an account, purchasing access or using the platform, you agree to these terms.

1. About SmartDrive Kenya

SmartDrive Kenya is an independent educational and revision platform designed to help learners prepare for Kenyan driving-school examinations and improve their knowledge of road safety.

SmartDrive Kenya may provide driving-theory notes, road-sign revision, Model Town Board training, practical-driving guidance, mock examinations and AI-assisted learning.

SmartDrive Kenya is not the National Transport and Safety Authority (NTSA), is not operated by NTSA, and does not claim to be officially affiliated with or endorsed by NTSA.

2. Educational Purpose

SmartDrive Kenya is provided for education, training and examination-revision purposes.

Use of the platform does not guarantee that a learner will pass an NTSA examination, obtain a particular score, receive a driving licence or receive approval from any government authority.

Learners remain responsible for completing any required formal training and following instructions from qualified driving instructors and authorised examiners.

3. User Accounts

Each SmartDrive Kenya account is intended for one individual learner only.

Users are responsible for keeping their login information secure.

Accounts must not be sold, transferred, rented, shared or provided to another person.

SmartDrive Kenya may temporarily restrict or suspend an account where there is reasonable evidence of account sharing, unauthorised access or attempts to bypass platform security.

4. Free and Premium Services

Some SmartDrive Kenya educational materials may be available free of charge.

Other features may require valid premium access, including the SmartDrive Kenya Examination Centre, premium mock examinations, Mwalimu SmartDrive Kenya AI Tutor and other services identified as premium.

Creating an account or logging in does not automatically provide premium access.

Premium services remain subject to the payment, access-period and eligibility requirements displayed on the platform.

5. Premium Access

The standard SmartDrive Kenya premium package is currently:

KES 200 for 30 days of access, unless another price or promotional offer is clearly displayed before payment.

Premium access starts after successful payment confirmation and activation.

Access expires at the end of the applicable period unless renewed.

6. Examination Centre

SmartDrive Kenya mock examinations are revision tools.

They are not official NTSA examinations.

SmartDrive Kenya does not guarantee that questions appearing in its Examination Centre will be identical to those appearing in an official examination.

Question banks, examination layouts, time limits and other examination features may be updated as the platform improves.

7. Mwalimu SmartDrive Kenya AI Tutor

Mwalimu SmartDrive Kenya is an AI-assisted educational tool intended to help learners understand driving-school topics.

The AI Tutor may be subject to usage limits, credit limits, premium-access requirements or other platform restrictions.

AI-generated responses may occasionally contain errors or incomplete information. Users should treat the AI Tutor as a revision assistant rather than a replacement for formal driving instruction or official requirements.

8. AI Credits and Top-Ups

Where premium access includes AI credits, those credits are available only for use through SmartDrive Kenya.

AI credits:

  • have no cash value;
  • cannot be transferred to another account;
  • cannot be exchanged for money; and
  • may expire according to the applicable package.

Where additional AI credits are available for purchase, the applicable price and credit amount will be shown before payment.

9. Payments

Payments may be processed using supported third-party payment providers, including M-Pesa payment services.

SmartDrive Kenya does not require users to provide their M-Pesa PIN directly to SmartDrive Kenya.

Users are responsible for providing correct payment information.

Premium access may remain unavailable until payment has been successfully confirmed.

10. Refunds

Payments for activated digital access are generally non-refundable, subject to the SmartDrive Kenya Refund Policy and any legal rights that cannot lawfully be excluded.

Duplicate payments, confirmed technical payment errors or exceptional cases may be reviewed individually.

11. Account Sharing

Premium access is personal and non-transferable.

SmartDrive Kenya may use reasonable technical safeguards to prevent multiple people from using one premium account simultaneously.

Attempts to bypass account-sharing restrictions may result in temporary suspension or termination of premium access.

12. Acceptable Use

Users must not:

  • bypass payment or premium-access restrictions;
  • share premium accounts;
  • interfere with website security;
  • manipulate examination records or results;
  • copy or redistribute substantial amounts of protected premium material;
  • use automated tools to extract large quantities of SmartDrive Kenya content; or
  • deliberately disrupt the service for other users.

13. Intellectual Property

SmartDrive Kenya’s original lessons, question banks, software customisations, branding, website design and other original materials remain the property of SmartDrive Kenya or their respective rights holders.

Purchasing access gives a user a limited, personal and non-transferable right to use the material for private learning and revision.

It does not transfer ownership of the material.

14. NTSA and Third-Party References

References to NTSA, Kenyan road laws, traffic signs and other public organisations or standards are used for educational and descriptive purposes.

Their inclusion does not imply sponsorship, partnership or endorsement.

Third-party names, trademarks and materials remain the property of their respective owners.

15. Service Availability

SmartDrive Kenya aims to provide reliable access but cannot guarantee uninterrupted service.

Temporary interruptions may occur because of maintenance, hosting problems, software updates, internet failures, payment-provider issues or circumstances outside SmartDrive Kenya’s reasonable control.

16. Changes to Content and Features

SmartDrive Kenya may update lessons, questions, examinations, AI features, prices or platform functionality where necessary to improve accuracy, security or usability.

Changes to future pricing will be displayed before a new purchase is completed.

17. User Responsibility

SmartDrive Kenya provides educational assistance but does not control official examination results, licensing decisions or government procedures.

Users remain responsible for their own examination preparation, driving behaviour and compliance with Kenyan road-safety requirements.

18. Suspension or Termination

SmartDrive Kenya may suspend or terminate access where there is serious or repeated misuse, including fraud, account sharing, deliberate circumvention of access restrictions or harmful interference with the platform.

19. Privacy

Personal information collected through SmartDrive Kenya is handled according to the SmartDrive Kenya Privacy Policy.

Third-party payment providers may also process information under their own privacy and security policies.

20. Changes to These Terms

SmartDrive Kenya may update these Terms & Conditions as the service develops.

The latest version will be published on the website together with its effective date.
