We may also process information relating to your course enrolment, lesson progress, course completion, mock-examination attempts and results, premium-access status, AI Tutor usage, AI-credit balances, support requests and basic device or browser information.
We aim to collect only information reasonably necessary to operate, secure and improve SmartDrive Kenya.
3. Information You Provide When Registering
When you create a SmartDrive Kenya account, you may be asked to provide information such as your name, username, email address and password.
You are responsible for providing accurate information and protecting your account credentials.
Passwords should be kept confidential and should not be shared with other people.
4. How We Use Personal Information
SmartDrive Kenya may use personal information to create and manage accounts, enrol learners in courses, remember learning progress, provide mock examinations and results, activate premium services, confirm payments, provide Mwalimu SmartDrive Kenya AI Tutor, manage AI credits, prevent account sharing and fraud, provide support, diagnose technical problems, improve the platform and comply with applicable legal obligations.
We do not intend to use personal information for purposes that are incompatible with the reason for which it was collected without an appropriate lawful basis.
5. Learning and Examination Records
SmartDrive Kenya may maintain records relating to your learning activity, including lessons completed, course progress, examination attempts and examination results.
This information allows the platform to remember your progress and provide relevant learning and revision features when you return.
Your SmartDrive Kenya mock-examination results are educational records and are separate from any official NTSA examination record.
6. Premium Access Information
Where you purchase or receive premium access, SmartDrive Kenya may maintain information about your premium status, activation date, expiry date, available features and related account entitlements.
Simply creating or logging into an account does not automatically create a premium entitlement.
7. Payment Information
SmartDrive Kenya may use third-party payment providers to process payments, including M-Pesa-enabled payment services.
SmartDrive Kenya may receive information needed to verify a transaction, such as the payment amount, payment status, phone number associated with the transaction, transaction reference and payment date.
SmartDrive Kenya does not require you to provide your M-Pesa PIN through the SmartDrive Kenya website.
Never send your M-Pesa PIN, banking password or other private security credentials through a SmartDrive Kenya form, message or AI conversation.
8. Mwalimu SmartDrive Kenya AI Tutor
When you use Mwalimu SmartDrive Kenya AI Tutor, the questions or messages you submit may be processed by technology providers used to generate an educational response.
AI-related information may also be used to manage usage limits, calculate remaining credits, prevent abuse and maintain service reliability.
Do not submit unnecessary sensitive personal information to the AI Tutor.
AI conversations should be used for driving education and revision rather than as a place to store private personal information.
9. Cookies and Website Technology
SmartDrive Kenya may use cookies and similar technologies necessary for the operation of the website.
These technologies may help keep users signed in, maintain secure sessions, remember account settings, preserve course progress, support payment and checkout functions, maintain security and improve website performance.
Some third-party services integrated into SmartDrive Kenya may also use cookies or similar technologies according to their own policies.
10. Legal Reasons for Processing Information
Depending on the circumstances, SmartDrive Kenya may process personal information because it is necessary to provide a service requested by the user, manage an account or purchase, comply with legal obligations, protect the legitimate security and operation of the platform, or because the user has provided consent where consent is appropriate.
Kenya’s data-protection framework requires personal data to be processed consistently with privacy rights and applicable data-protection principles.

This may include website-hosting providers, payment processors, email providers, security services, learning-management technology providers, AI service providers and other technical infrastructure providers.
Information may also be disclosed where SmartDrive Kenya is legally required to do so.
Service providers should receive only the information reasonably necessary for the service they perform.

Where personal information is transferred outside Kenya, SmartDrive Kenya will seek to use appropriate safeguards and comply with applicable requirements governing international transfers of personal data.
13. How Long We Keep Information
SmartDrive Kenya aims to retain personal information only for as long as reasonably necessary for the purpose for which it was collected.
Retention may be necessary for purposes such as maintaining accounts and learning records, resolving payment disputes, detecting fraud or account misuse, providing customer support and satisfying applicable accounting or legal obligations.
Information that is no longer reasonably required may be deleted, anonymised or otherwise securely disposed of where appropriate.
14. Protecting Your Information
SmartDrive Kenya uses reasonable technical and organisational safeguards intended to protect personal information from unauthorised access, misuse, alteration or loss.
These safeguards may include secure account authentication, restricted administrative access, secure website connections, account-sharing controls, software updates and security monitoring.
No internet-based system can guarantee absolute security, so users should also protect their passwords, devices and email accounts.
15. Your Data Protection Rights
Under Kenya’s data-protection framework, users have important rights concerning their personal information. These include the right to be informed about how personal data is used, to access personal data held about them, to object to certain processing, to request correction of false or misleading data, and to request deletion of false or misleading data.
Requests to exercise applicable rights may be submitted through the official SmartDrive Kenya contact channels.
Some requests may be subject to legal limitations or legitimate record-keeping obligations.
16. Children and Younger Learners
SmartDrive Kenya may be used by younger learners studying driving theory.
Where a user is legally considered a child, SmartDrive Kenya will seek to handle that user’s information with additional care and in accordance with applicable requirements concerning children’s personal data.
The ODPC states that where a data subject is a minor, applicable data-protection rights may be exercised by a person with parental authority or a guardian. The ODPC has also issued specific guidance regarding children’s personal data.
SmartDrive Kenya does not require younger learners to provide unnecessary sensitive personal information.
17. Correcting or Deleting Information
If information associated with your SmartDrive Kenya account is incorrect, you may contact SmartDrive Kenya and request that it be reviewed or corrected.

If SmartDrive Kenya becomes aware of a significant security incident involving personal information, appropriate steps may be taken to investigate the incident, reduce further risk, protect affected systems or accounts and make any notifications required under applicable law.
19. Third-Party Services

Those providers may operate under their own privacy policies, security practices and legal obligations.
SmartDrive Kenya is not responsible for independent third-party websites that a user voluntarily leaves SmartDrive Kenya to visit.
